Amended Asbestos Regulations

The Safety, Health and Welfare at Work (Exposure to Asbestos) (Amendment) Regulations 2010 have just been signed into law. These regulations amend a number of the provisions of 2006 Asbestos Regulations.

Below is the summary of the new provisions: 

  1. Regulation 15 (Plan of Work) has been extended and now includes repair and maintenance
  2. Regulation 15 has been re-enacted and a number of new or revised sub-clauses were added
  3. Employers are now obliged to make medical records of staff who ceased employment available  by their medical practitioner to the Health and Safety authority or their nominated body (Regulation 25)
  4. Regulation 26 has been re-enacted with a provision in relation to the application of asbestos by spraying
  5. When an activity is carried out which has a potential to expose employees to asbestos, a copy of the plan of work is required to be made available to the HSA.

The HSA are due to publish guidance notes early next year.
